Fair Labor Standards Act – see chapter 19 attachment
• What is the Fair Labor Standards Act?
• What rights does it guarantee and to whom does it guarantee them?
• Also, think about independent contracts (see chapter one PP attachment) and comment, using the new information you read in chapter 19 to explain why proper classification is so important.
FLSA Exemptions
• Use both your textbook (chapter 19) and the link below (FLSA Exemptions) along with the attachment named “DOL Finalizes Overtime Rule” for this discussion. Know that many exemptions exist to the FLSA and pay special attention to the following three: Executive, Professional, Administrative. Understand that to qualify for each of these exemptions, the employee must meet both a salary test and a duties test.
• Your written discussion post should identify the two tests (salary and duty) for each of the three exemptions, discuss why you think the government allowed for these three exemptions and provide your opinion as to whether or not they are fair.
• Finally, note that the salary test portion of these exemptions changed relatively recently and is changing again as of January 1, 2025. What challenges does that create for employers?
